Terms of Service
1. Who we are
These Terms of Service ("Terms") govern the services provided by Toronto Smart Mount ("we", "us", "our"), a television mounting and installation service operating in Toronto and the Greater Toronto Area, including downtown Toronto, North York, East York, Scarborough, Markham, Vaughan, Richmond Hill, Pickering, Ajax and surrounding communities. By booking an appointment on our website, by phone or by message, you ("you", "the customer") agree to these Terms.
2. Services
We provide professional TV wall mounting and related services, including supply of wall mounts, in-wall and on-wall cable concealment, soundbar and accessory mounting, removal of existing mounts, and multi-TV installations for homes and businesses. The scope of each job is defined by the options you select in our online price calculator or, for commercial work, by the written quote we provide.
3. Quotes and pricing
- The price shown by our online calculator is the price you pay for the selected scope, provided the information you gave us is accurate (TV size, wall type, selected options).
- If conditions on site differ materially from what was selected (for example, a concrete wall selected as drywall, no safe power access, or structural issues), we will explain the difference and give you a revised price before any work starts. You may accept the revised price or cancel at no charge beyond the deposit terms in section 5.
- Commercial and multi-unit work is quoted individually and no work begins before a written quote is accepted.
- All prices are in Canadian dollars. HST (13%) applies to all services and is shown at checkout.
4. Booking and scheduling
- A booking is confirmed once you receive our confirmation message with a date and arrival window.
- We will always aim to arrive within the stated window. If we are delayed, we will notify you as early as possible and offer the next available time if the delay does not work for you.
- You agree to have the installation area reasonably accessible, the TV on site, and a decision-maker (18 years or older) present during the appointment.
5. Deposit, payment and cancellations
- A $25 deposit is required to reserve your appointment. The deposit is applied in full against your total price. The remaining balance is due on completion of the work, on site.
- We accept major credit and debit cards through our secure checkout, and other methods as offered at the time of payment.
- You may reschedule or cancel free of charge up to 24 hours before your appointment window; your deposit is refunded or transferred to the new date, your choice.
- Cancellations with less than 24 hours notice, or a no-show at the appointment (no access to the premises, TV not on site), forfeit the deposit. We apply this policy reasonably: documented emergencies are always accommodated.
- If we must cancel and cannot offer you a replacement time within a reasonable period, your deposit is refunded in full.
6. Your responsibilities
- You confirm you own the premises or have the owner's or landlord's permission to have work performed, including drilling into walls.
- You are responsible for disclosing anything you know about the wall and the area behind it, including known plumbing, electrical, alarm or data lines, in-wall heating, and previous repairs.
- You are responsible for the accuracy of the TV size, wall type and options selected when booking.
- Please secure pets and keep children clear of the work area during the installation.
7. Hidden conditions and pre-existing issues
Walls can conceal conditions that no installer can detect with certainty, even with scanning tools. We take every professional precaution, including stud detection and scanning before drilling. However:
- We are not responsible for damage to concealed utilities or structures that were not disclosed to us and could not be detected with standard professional scanning tools.
- We are not responsible for pre-existing conditions, including previously damaged drywall, failed previous installations, walls that do not meet building code, or structural inadequacy of the wall itself.
- If we identify a wall as unsuitable or unsafe for the requested installation, we will tell you and propose alternatives. We reserve the right to decline work we consider unsafe, with any deposit refunded in full.
8. Equipment and third-party products
- Wall mounts we supply are covered by our warranty (see the Workmanship Warranty below) and by the manufacturer's warranty where applicable.
- If you supply your own mount, we will install it with the same care, but we cannot warrant the mount itself, its weight rating, or its compatibility beyond a visual and specification check.
- Your TV remains covered by its manufacturer's warranty. We are not responsible for defects in the TV itself, including pre-existing panel damage. We inspect and note visible TV condition before starting.
9. Our liability
We carry liability insurance and stand behind our work. To the maximum extent permitted by applicable law, our total liability for any claim arising from a job is limited to the greater of the amount you paid us for that job or the direct cost to repair damage we caused through our own negligence. We are not liable for indirect or consequential losses, including loss of use or loss of content or data on connected devices. Nothing in these Terms limits liability that cannot be limited under the law of Ontario, including liability for our own gross negligence, or your rights under applicable consumer protection legislation.
10. Reviews, photos and marketing
With your permission at the time of the job, we may photograph the finished installation for our portfolio and social media. We never publish anything that identifies your address, and we will not use photos if you decline. Declining has no effect on your service or warranty.
11. Disputes
If something is not right, contact us first: we fix workmanship issues under our warranty, quickly and at no charge. These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable in it. Any dispute that cannot be resolved between us will be brought in the courts of the judicial district where the work was performed.
12. Changes to these Terms
We may update these Terms from time to time. The version in force when you book applies to your job. The "Last updated" date at the top of this page reflects the latest revision.
Privacy Policy
1. Our commitment
Toronto Smart Mount collects only the personal information needed to quote, book, perform and follow up on your installation. We comply with the Personal Information Protection and Electronic Documents Act (PIPEDA).
2. What we collect
- Contact details: name, phone number, email address.
- Job details: service address in the Toronto area, TV and wall information, selected options, appointment date and time, and any photos or videos you choose to send us of your space.
- Payment information: processed entirely by our payment provider through a secure, PCI-compliant checkout. We never see or store your full card number.
- Website data: basic analytics such as pages visited and approximate location (city level), used to improve the website. We do not sell data to anyone and we do not use it for third-party advertising.
3. How we use it
- To provide quotes, confirm bookings, schedule and perform your installation.
- To contact you about your appointment (confirmations, reminders, arrival updates).
- To follow up after the job, including warranty service and an invitation to leave a review. Review invitations are optional and you can ignore or opt out of them at any time.
- To keep records required for accounting and tax purposes.
4. What we never do
- We never sell, rent or trade your personal information.
- We never share your information with third parties except the minimum necessary to deliver the service: our payment processor for payments, and our booking and messaging tools for scheduling and communication. Each of these providers is bound by its own privacy and security obligations.
- We never send marketing you did not agree to receive, and every marketing message we do send includes a way to unsubscribe, as required by Canada's Anti-Spam Legislation (CASL).
5. Photos and videos you send us
Photos or videos you upload with a quote request are used only to prepare your quote and plan the job. They are stored securely and deleted on request. Photos of completed work are only published with your permission, as described in the Terms of Service.
6. Retention and security
We keep job records for as long as needed to honour your warranty and meet legal record-keeping requirements (generally seven years for financial records), after which they are deleted. Information is stored in reputable, access-controlled cloud services. Access is limited to the people who need it to serve you.
7. Your rights
You may ask us at any time to show you the personal information we hold about you, correct it, or delete what we are not legally required to keep. Contact us using the details on our website and we will respond within 30 days. If you are not satisfied with our response, you may contact the Office of the Privacy Commissioner of Canada.
8. Cookies
Our website uses only the cookies necessary for it to function (for example, keeping your calculator selections during checkout) and basic, privacy-respecting analytics. We do not use third-party advertising cookies.
Workmanship Warranty
1. What is covered
Every installation we perform is covered by a 1-year workmanship warranty from the date of installation. If a mount we installed loosens, shifts, or pulls from the wall under normal use within one year, we will return, correct it, and repair any wall damage caused by the failure, at no charge. Mount hardware we supplied is also covered against defects for the same period.
2. What is not covered
- Damage caused by impact, misuse, overloading the mount beyond its rating, or modification of the installation by anyone other than us.
- Customer-supplied mounts and hardware (we warrant our installation work on them, not the products themselves).
- The TV and other electronics, which remain under their manufacturers' warranties.
- Settling cracks, paint variations or minor cosmetic marks inherent to drilling into any wall, disclosed before work begins.
- Failures caused by concealed wall conditions that could not be detected with standard professional tools, as described in the Terms of Service.
3. How to make a claim
Contact us with your name, installation address and a photo of the issue. We aim to respond within one business day and to schedule warranty visits ahead of new installations. Warranty service is free. There is no paperwork beyond your original booking confirmation, which we keep on file for you.
4. Satisfaction promise
Beyond the formal warranty above, our working promise is simple: if you are not happy with the height, angle or cleanliness of the result on the day of installation, tell the installer before they leave and we will adjust it on the spot at no charge.
